Nagrik Chetna Manch (NCM) filed a Contempt Petition (21656 of 2015) on 6th July 2015 initiating proceedings for committing civil contempt of the Hon’ble by violating it’s interim orders dated 23.09.2013 and 16.03.2015 in Writ Petition (Civil) 494 of 2012 and dated 24.02.2014 in Special Leave Petition (Criminal) 2524 of 2014. The contemnors are (1) Pradeep Kumar Sinha, Cabinet Secretary, Union of , (2) Swadheen S Kshatriya, Chief Secretary , (3) Raghuram Rajan, Governor, Reserve Bank of India (4) Nasim Zaidi, Chief Election Commissioner, of India.

NCM noticed that there was a spurt of directives in the last few months by both the Central and State governments violating the orders of the Supreme Court by mandating linkages of benefits to the possession of Aadhaar number. We give below a few examples for the basis of the Contempt Petition.

The Department of Electronics and Communication Technology integrated Aadhaar to draw benefits in the newly launched Digital India Program. The Ministry of Labour and Employment made Aadhaar card compulsory for ESI services. The Ministry of New and Renewable Energy made Aadhaar mandatory for receiving capital subsidy. The Ministry of Rural Development made Aadhaar compulsory for MNREGA services.

The Govt. of made Aadhaar compulsory for ration services at Fair Price Shops and for school admissions and the Election Commission of India issued instructions for linking Aadhaar card with Elector’s Photo Identity Card.

In it’s interim order dated 23.09.2013 passed in WP (C) 494 of 2012, the Supreme Court had directed, “in the meanwhile no person should suffer for not getting the Aadhaar number and when any person applies to get the Aadhaar number voluntarily, it may be checked whether the person is entitled for it under law as it should not be given to any illegal immigrant.” In its order dated 24/03/2014 in SLP 2524/2014 filed by the Unique Identification Authority of India against the Central Bureau of Investigation and others, the Supreme Court had restrained the UIDAI from transferring any biometric information of any person to any other agency without a written consent.

Nagrik Chetna Manch has prayed for prohibition of linkage of Aadhaar number to any benefits, to end the discrimination of persons into Aadhaar and non-Aadhaar residents and restrain the from transferring any biometric information of any person from or to any other agency without specific written permission.

NCM’s Contempt Petition 21656 of 2015 in the Supreme Court

On 6th July 2015, Nagrik Chetna Manch (NCM) filed Contempt Petition bearing no. 21656 / 2015 under Art 129 & 142 of the Constitution of India read with section 12 of the Contempt of Courts Act 1971 for initiating contempt proceedings against the Contemnors for committing Civil Contempt of Hon’ble Supreme Court whereby violating it’s interim orders dated 23.09.2013 and 16.03.2015 passed in WP (C) no. 494 of 2012. As well as order dated 24.02.2014 passed by Hon’ble Supreme Court in SLP (Crl) no. 2524 of 2014. Contemnors being (1) Pradeep Kumar Sinha, Cabinet Secretary, Union of India, (2) Swadheen S Kshatriya, Chief Secretary Government of Maharashtra, (3) Raghuram Rajan, Governor, Reserve Bank of India (4) Nasim Zaidi, Chief Election Commissioner, Election Commission of India.

Earlier NCM had filed WP no. 932 of 2013 in public interest against the use of the UID number by RBI, ECI, RGI and GoI on the grounds mentioned in the WP in which notice had been issued on 19.11.2013 by the Hon’ble Supreme Court and the same was tagged with aforesaid WP (C) 494 of 2012.

In it’s interim order dated 23.09.2013 passed in WP (C) no. 494 of 2012, the Hon’ble Supreme Court while feeling importance of this matter, listed it for final hearing. And also directed that in the meanwhile no person should suffer for not getting the Aadhaar number and when any person applies to get the Aadhaar number voluntarily, it may be checked whether the person is entitled for it under law as it should not be given to any illegal immigrant.

In an order dated 24/03/2014 in another matter Special Leave to Appeal (Crl) No.2524/2014 filed by the Unique Identification Authority of India (UIDAI) against the Central Bureau of Investigation () and others, the Supreme Court had restrained the UIDAI from transferring any biometric information of any person who has been allotted the Aadhaar number to any other agency without his consent in writing. The order further stated that no person shall be deprived of any service for want of Aadhaar number in case he/she is otherwise eligible/entitled. All the authorities were directed to modify their forms/circulars/likes so as to not compulsorily require the Aadhaar number in order to meet the requirement of the interim order passed by the Hon’ble Supreme Court.

Despite these orders neither the nor States and their functionaries have been complying the orders of the Supreme Court in letter and spirit. They have continued to cause suffering by continuously mandating more and more for registration and linkages to the Aadhaar. The NCM quotes a few examples of the violations by the contemnors in the Petition.

The Department of Electronics and Communication Technology, for example, launched the Digital India Program on 1st July 2015. This program integrates Aadhaar as a mandatory feature to draw any benefits. The Ministry of Labour and Employment, Govt. of India issued advertisement in for making Aadhaar card compulsory for ESI services. The Ministry of New and Renewable Energy, Govt. of India issued notice No. 5/34/2013-14/RT dated 01.01.2015 for making Aadhaar card compulsory for receiving capital subsidy. The Ministry of Rural Development, Govt. of India issued letter dated 18.02.2015 and again on 25.02.2015 for making Aadhaar card compulsory for MNREGA services. The Minister of Rural Development, Govt. of India answered a unstarred question on 05.03.2015 whether the Union Government proposes to link accounts opened under Pradhan Mantri Jan Dhan Yojana with Aadhaar number to transfer subsidy and wages under MGNREGS directly indicating that “The States have been asked to take active measures to link the bank accounts of the workers with their Aadhaar numbers. In order to make use of the benefits under the PMJDY, all States have been requested to undertake an immediate drive to open Pradhan Mantri Jan Dhan Yojana (PMJDY) accounts for all the active wage seekers who already do not have a Bank/ Post Office account in the nearest commercial Bank/ Post Offices. Wherever accounts have been freshly opened by MGNREGA workers under the PMJDY, such accounts are being linked with Aadhaar number of the beneficiaries.”

The Govt. of Maharashtra issued Cabinet Resolution dated 03.03.2015 for making Aadhaar card compulsory for ration services at Fair Price Shops. The Resolution also requires the transfer of biometric information to the Govt. of Maharashtra despite there being no consent in writing of the persons whose biometric it may be. The Govt. of Maharashtra issued GR dated 21.04.2015 for making Aadhaar card compulsory for school admissions.

The Reserve Bank of India issued letter dated 26.11.2013 for making Aadhaar card readers compulsory for all new infrastructure services.

The Election Commission of India issued letter dated 27.02.2015 for linking Aadhaar card with EPIC. This process of seeding is meaningless without discriminating, and thus causing to suffer, those without an Aadhaar.

In the meanwhile as the common man continues to suffer the Aadhaar, NCM has alleged in its Petition 932 of 2013, that the linkage of Aadhaar to various databases is destroying governance and ability to govern. NCM has also highlighted that it will end the rule of law and perhaps even compromise the sovereignty of India. Such linkage of bank accounts to Aadhaar is facilitating money laundering. Linkage of Aadhaar to the EPIC and NPR is destroying the ability to distinguish citizens from residents and giving citizenship to illegal immigrants as well as anti-nationals.

NCM in the CP filed, prays for prohibition of operations related to Aadhaar number by Contemnors forthwith and until final disposal of WP (C) no.494 of 2012, require contemnors to end suffering caused by discrimination of persons into Aadhaar and non-Aadhaar residents through the continued usage or seeding of Aadhaar by any agency and restrain the contemnors from transferring any biometric information of any person who has been allotted the Aadhaar number from or to any other agency.

Milan Gupta's formal complaint to the Election Commission against Aam Aadmi Party establishes that the 28th march NC meeting was unconstitutional and asks EC to demand unedited footage from all cameras.

This is with reference to Aam Aadmi Party's(AAP) press release dated 28 March 2015 made available by the party's secretariat to the media,the party members, the general public (and the Election Commision of India) through the party's official website link http://www.aamaadmiparty.org/aam-aadmi-party-press-release-28th-march-2015 

Vide the aforesaid press release it has been informed that the National Council of AAP met on 28th March 2015 in which certain decisions and resolutions were taken. A copy of the press release is attached for your convenience, as Annexure 1  (You may cross verify the contents of the attachment with the aforesaid internet link too if you like.)In case, Aam Aadmi Party's secretariat has sent a written communication to Election Commission of India(ECI) with respect to the purported National Council meeting of 28 March 2015, kindly consider this email with reference to such a communication also. (Kindly request you to upload such a written communication on ECI's website also, in that case).

I am a member of Aam Aadmi Party. Attached with this email in Annexure 2 is my profile summary(with my earlier residential address) that was displayed on Aam Aadmi party's official website.

I bring to your attention that the purported National Council meeting of AAP on 28 March 2015, as informed vide the aforementioned press release, was wholly ultra-vires the constitution of AAP on records of the ECI. The irrefutable evidence of its illegality has been furnished by the party's secretariat itself.

The party's secretariat has claimed vide the aforementioned press release in para 2(a) that out of a total of 392 members of the National Council, 311 attended the meet. I shall demonstrate here that total strength of National Council members is not more than 300, and the figure of 392 members is therefore wholly false, misleading and contemptuous of basic respect of rules and laws.

Article IV- F of AAP constitution registered with ECI governs the composition of the National Council. As per the article, the National Council consists of convenors from all the states and the districts. In addition , it can co-opt upto a maximum of 50 members. It is not a matter of dispute, so far, that the no member has been co-opted into the National Council till date(In case, it is claimed so by the party' secretariat, even that will not explain the super high figure of 392 members in the National Council).

AAP;s constitution, like all the democratic parties' constitution, has clearly written throughout that the convenors at all levels are elected, and not appointed. The Active Members with voting rights as defined in AAP constitution are the foundation of the party who make AAP a bottom-up elected organisation. 

Article IV-D-c(i) and (vi)  specify that the District Convenor shall be elected by District executive, which in turn shall be elected by Active members in that district.

Similarly,  article IV-E-c(i) and (vi) state that the State convenor shall be elected by State executive, which in turn shall be elected by Active members in that state.

Article III-C-vi mentions that the list of Active members shall be frozen one month before the call for any party elections.

However, there are no active members list or any such party elections held anywhere in the party through Active members(except, in National Council members' first meeting on 24 Nov 2012). The evidence of this has been provided by the party's secretariat itself in the edited video recording of the purported National Council meeting of 28 March 2015.

You may prefer to focus on the contents in that video for duration between 34 minutes 5 seconds to 37 minutes 50 seconds in it.

In the video, the National Convenor of AAP, while commenting and admitting on flaws in the internal organisational setup( between 34 minutes 30 seconds and 34 minutes 40 seconds) states as follows "... अभी Active members की list है नहीं .. आपको भी पता है .. हमने कहा committees बनायीं जाएँगी , हर राज्य में committee बनायेंगे , active members की list बनायेंगे, public कर देंगे.."

Further, the National Convenor admits while specifically taking the example of organisation set up in a particular state  that voting withing party is in fact missing in the entire country, not just that particular state. The National Convenor says ( between 37 minutes 24 seconds and 37 minutes 44 seconds)

"..  एक साल में कितनी voting करायी हरियाणा में ? यहाँ पर हरियाणा के साथी भी होंगे ..हाँ भाई कितनी वोटिंग करायी ?...एक वोटिंग हुई हो पूरे.. कुछ लागू तो कर के दिखाओ ..कुछ कर के तो दिखाओ ..हरियाणा में लागू कर दो हम पूरे देश में लागू कर देंगे ..)

The above statements of the National Convenor ,released officially by the party's secretariat too, are a self-providing evidence that active members list is not available, active members have not been identified, and there have been no internal party elections through out the country.

Therefore, no district convenors or state convenors can become part of AAP's National Council since no elections have taken place throughout the country for them, through a duly maintained Active Members list as per AAP's constitution.

The National Council can be composed, therefore, only as per provision in Article IV- F which states as "All those who come together to form the Party and are present in the first meeting of the Party, shall form the first National Council of the Party."

At this point, kindly refer to letter number 4/RTI/32/2015/PPS-II/347 dated 25th February, 2015 sent by Sh Suman Kumar Das, Under Secretary, CPIO, to the undersigned in response to an RTI application filed by me in this regard wherein I had requested to be provided the names, in serial order, of the persons who came together to form the Aam Aadmi Party.

I was informed that document in this regard runs to 957 pages, and I could get the same on payment of Rs 1914/-. I made the payment vide receipt number 20098 dated 09/03/2015 to the ECI, and received the required documents accordingly

The total number of persons, in the records of ECI shared with me as above or otherwise, who came together to form the Aam Aadmi Party does not exceed 300. This is clearly a matter of record with ECI and is verifiable.

Therefore, the National Council members cannot exceed 300 in total as per records available with ECI, the AAP constitution registered with ECI, and the admitted video evidence shared as above.

It is thus demonstrated that the purported National Council consisting of 392 members as informed vide the press release that met on 28 March 2015 was completely ultra-vires the AAP constitution, and the figures quoted by the party secretariat are false, misleading and demeaning to average constitution abiding party members and citizens.

Also ,there are many National Council members on records of ECI  also, who have not been served any notice of expulsion by AAP, but were not allowed to attend the purported National Council meet of 28th March 2015. Such members are also willing to make a written statement to that effect and this has been reported in the media too.

Besides, the aforesaid evidence, there have been much more serious and grave reports of violence, subjugation & coercion having held inside the private and heavily guarded closed venue of the aforementioned purported National Council meet. In fact, the local law and order administration has had to duly register a FIR (Number 143 of 2015 dated 30/0/2015 at P.S. Kapashera) under various sections of the Indian Penal Code. A copy of the FIR is attached in this mail as Annexure 3.

Aam Aadmi Party is not only a registered party under section 29A of Representation of People's Act, 1951, it is also a recognised party by the Election Commission of India, under the Election Symbols(Reservation and Allotment) Order , 1968. Under para 16A of the Symbols order, every recognised party is expected to follow lawful directions and instructions of the Commission which it discharges under broad authority of article 324 of Constitution of India.

In exercise of such powers under para 16A of Symbol order, article 324 of Constitution of India, and with view of safeguarding general public interest in maintaining faith in democracy based on certain concessions to recognised parties and with the evidences presented to you I sincerely urge you to kindly

1) Instruct the Aam Aadmi party's National Secretary, Sh Pankaj Gupta, to share the full unedited video recording of the proceedings of the purported National Council meeting of 28 March 2015 with the Election Commission of India. The unedited video recordings must contain recordings from all cameras present in the venue. No record of Election Commission of India, shall be updated with respect to the National Council meet of 28 March without making the full unedited video recordings available to the Commission.

2) Instruct the SHO, P.S. Kapashera, to share the full collected video evidence against FIR 143 of 2015 with the Election Commission of India.

3) Declare that the the aforementioned press release in Annexure 1 from Aam Aadmi Party's secretariat  or any written communication to Election Commission with regard to the purported National Council meeting of 28 March 2015,as ultra-vires in light of evidence available and made available. 

4) Declare the purported National Council meet of Aam Aadmi Party of 28 March 2015 as ultra vires of the AAP constitution in light of evidence available and made available to the Election Commission.

5) Declare the purported National Council meet of Aam Aadmi Party of 28 March 2015 as ultra vires in light of  sufficient coercion and violence  at the venue.

AAP volunteer Milan Gupta has filed an RTI with the Election Commission and obtained the National Council Members list that Aam Aadmi Party should have published on their website and has not. Milan Gupta has made the list public.

Milan Gupta, a worker of Aam Aadmi Party has released the National Council member list that Aam Aadmi Party has not put up on its website and is calling out to supporters of Aam Aadmi Party to urge them to attend the National Council meeting and strive to save the party from its imminent sabotage. What begins as a random interview of party volunteers takes on an ominous turn as the supporter claims to be a candidate of another party contesting to undermine Arvind Kejriwal's votes and managing another party "global acting president" of Ojaswi party of Asaram and his son Narayan Sai. He confesses on camera to publishing a crore booklets calling Arvind Kejriwal a traitor and distributing them ahead of Lok Sabha Elections. He says he handed the first booklet to Kejriwal before assaulting him (so much for BJP's accusations of AAP planting attackers).

Then he claims that they shot Gandhi - that Godse was a member of Hindu Mahasabha - and threatens to shoot Arvind Kejriwal dead if he does not understand his "explaining". This video needs to go to the Election Commission as well as the police.

The more the reporter gets the fanatic talking, the more the BJP caps around him realize what he's confessing and slink off camera (none disagree with him) and the video ends with locals confronting him about his claims of murder of Gandhi and threat to Kejriwal.

Anyone still wondering why BJP is losing this election? See this video to the end. The staunchest supporter would be revolted if he had an ounce of honesty left.

A lot of what he says is verifiable. The attack on Kejriwal, phone records could prove or disprove his claims of getting call from Modi, his records of being a candidate, membership of multiple parties is not legal in India, organized slander of a candidate, threat to Kejriwal is on record, defamation that puts Kejriwal's life at risk, and more.

This is probably the same Swami Om Ji who had demanded that the details of the Delhi Gang Rape be made public. (Apologies if incorrect, I cannot find a link for this, so going by memory - will verify and update)

There are many people on Twitter saying "he looks demented" etc. At the same time, he is confessing to serious crimes in a manner that is verifiable. He is a candidate contesting polls as another party while openly participating on the streets in support of BJP. That makes him important to investigate at the very least. Being demented does not mean he is not dangerous.

News media quoted Anna Hazare criticizing the Modi government on not fulfilling its promises re black money and Lokpal Bill. Here is a quote from January 29th, 2015 - Indian Express:

“Before he became the PM, Modi had promised to deposit Rs 15 lakh in every Indian’s account by bringing back black money. It has been eight months but none has got even Rs 15. Modi has refused to utter a word on black money and Lokpal appointment. There’s a huge difference between what Modi says and what he does,” he said, adding that he would soon launch a protest in Delhi against the central government.

Two days later, this ad is on the front page of the Indian Express (New Delhi edition). What appears to be a BJP campaign advertisement targeting Kejriwal also shows a photograph of Anna Hazare with a garland in the background. In India, a garlanded photograph has a specific symbolism - death. Photographs of living people are not garlanded as per Hindu belief.

Given that Anna Hazare has little to do with Arvind Kejriwal or his political party "Aam Aadmi Party", there appears to be no reason for Anna Hazare to be in the image - alive or dead. Nor does the text of the advertisement indicate any relevance.

Which leaves the mind troubled given the symbolism of the garland on the photo, and the position of the photo behind Arvind Kejriwal. It appears to be yet another of our government's menacing (but politically not incorrect) messages.

 

Update: Anna Hazare has said that he will complain to the Election Commission and file an FIR against BJP for the advertisement that shows a garland on his photograph. Here are screenshots from Total TV and AajTak. I will add links to videos as they become available.
